1. Definitions

• Platform: The Dreamers website/application.
• Creators: Users offering creative services.
• Clients: Users purchasing services.
• Order: A transaction between Creator and Client.
• Services: Work delivered via the Platform.

2. Eligibility

You must:

• be 18+
• have legal capacity
• comply with applicable laws

We reserve the right to verify identity and deny access without obligation to disclose reasons.

3. Account Registration

Users must provide accurate, current information.

You agree to:

• maintain confidentiality of login credentials
• notify us of unauthorized access
• accept responsibility for all account activity

We reserve the right to suspend or terminate accounts for violations, fraud, or suspicious behavior.

4. Marketplace Role

The Dreamers provides a platform for Users to connect.

We do not:

• perform the services listed
• guarantee results
• endorse specific Creators
• act as employer or agent of Creators
• become a party to contracts between users

Users interact and transact at their own risk.

5. Payment & Fees Policy

5.1 Creator Fee

Creators are charged a 20% service fee on all completed transactions, including tips and add-ons.

The fee is deducted automatically prior to payout.

5.2 Client Fee

Clients are charged a 5% platform service fee at checkout.

Minimum fees may apply.

5.3 Payouts

• Clearance period: 7 days after order completion.
• Minimum withdrawal: $25.

We may hold funds due to:

• disputes
• chargebacks
• fraud review
• policy violations
• security concerns

5.4 Chargebacks

We may reverse or withhold payouts if a chargeback or reversal occurs.

5.5 Payment Processing

Payments are processed via third-party providers.

By transacting, you accept their terms, conditions, and fees.

5.6 Taxes

Users are responsible for reporting and paying all taxes arising from the use of the Platform.

6. Refund & Cancellation Policy

Refunds are evaluated case-by-case.

Refunds may be issued when:

• no work delivered
• creator fails to meet requirements
• order canceled before work begins

Partial refunds may be issued when:

• partial work delivered
• order canceled mid-project

Refunds after payout may be offset from Creator's future earnings.

Platform fees may be non-refundable once work begins.

7. Cookie Policy

The Platform uses cookies to:

• authenticate users
• analyze usage
• enable core functionality
• store preferences
• enhance security
• provide personalization

Users may disable cookies, but some features may not function.

8. Creator Guidelines (Quality Standards)

Creators must:

• respond within 48 hours
• deliver work on time
• communicate professionally
• provide accurate descriptions
• deliver original work
• respect copyright laws
• provide revisions as listed

Creators may not:

• deliver plagiarized or stolen work
• use AI-generated content without disclosure when required
• abandon projects without notice
• harass or abuse clients
• attempt to bypass fees
• request off-platform payment or contact

Violations may result in account suspension or termination.

9. Client Guidelines

Clients must:

• communicate respectfully
• provide clear requirements
• not misuse revision requests
• not demand free work
• not harass creators
• not request illegal or prohibited content

10. Dispute Resolution

Disputes will be reviewed by The Dreamers.

Final decisions are binding.

Evidence may include:

• messages
• timestamps
• delivered files
• activity logs
• screenshots

Resolution timeframe: 48–120 hours, depending on complexity.

11. Anti-Circumvention Policy

Users may not:

• solicit or accept off-platform payments
• share personal contact information
• attempt to avoid Dreamers' fees
• redirect communication outside the platform

Violations may result in account closure and financial penalties.

12. Acceptable Use

Users may not upload content that is:

• illegal
• harmful
• obscene
• hateful or discriminatory
• infringing intellectual property rights
• malicious (viruses, bots, malware)

13. Intellectual Property

Creators retain rights to their work unless otherwise agreed.

Clients receive usage rights as specified in each service listing.

Users grant The Dreamers a license to display and operate content on the Platform.

14. Termination

We may suspend or terminate accounts at any time for:

• violations
• fraud
• misuse
• safety concerns

Balances may be held during investigation.

15. Limitation of Liability

The Platform is provided "AS IS".

We are not liable for:

• indirect damages
• lost profits
• lost data
• delays or service interruptions
• user conduct
• unauthorized access
• disputes between users

Maximum liability shall not exceed the amount paid to the Platform in the previous 60 days.

16. Changes to Terms

We may update these Terms at any time.

Revised dates will be posted.

Continued use constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of Delaware.
